Agreement to Terms

By accessing or using Servd ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Servd. We may modify these Terms at any time, and your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

Servd is a platform that helps users discover happy hour deals at restaurants and bars in Toronto. Our Service includes:

• Searchable database of happy hour deals
• Ability to save favorite deals to collections
• SMS notifications for saved deals (for subscribed users)
• Interactive maps to find nearby venues
• Itinerary planning features

We strive to provide accurate information, but we do not guarantee the accuracy, completeness, or availability of any happy hour deals listed on our platform. Deals are subject to change by the restaurants and venues at any time.

Subscription Plans

We offer different subscription tiers:

• Free Plan: Basic access to search and save deals with limited features
• Premium Plan ($4.99/month): Enhanced features including SMS notifications, unlimited collections, and advanced filters
• VIP Plan: Additional exclusive features (when available)

Billing and Payments

• Subscription fees are billed monthly in advance
• All payments are processed securely through our payment processor
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are in Canadian Dollars (CAD) and include applicable taxes

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. See our Refund Policy for more details.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated tools to scrape or extract data from the Service

• Upload or transmit viruses or malicious code
• Harass, abuse, or harm other users
• Use the Service to send spam or unsolicited messages
• Reproduce, distribute, or create derivative works of our content without permission

Intellectual Property

The Service and its original content, features, and functionality are owned by Servd and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

Our Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• The accuracy or completeness of happy hour deal information
• The availability of any restaurant or venue
• The quality of food or beverages at listed establishments
• Uninterrupted or error-free operation of the Service

We strongly encourage you to verify deal details directly with the restaurant or venue before visiting.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Servd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Conduct that may harm other users or the Service

Upon termination, your right to use the Service will cease immediately.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Severability
